By accessing or using Kaomochi (the 'Service'), you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service.

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

We reserve the right to modify these terms at any time. Continued use of the Service after changes constitutes acceptance of the updated terms. Material changes will be communicated via the platform.

User-generated content is the sole responsibility of its creators. By uploading content, you grant Kaomochi a non-exclusive, royalty-free, worldwide license to display, distribute, and store such content on the platform.

We reserve the right to remove any content, suspend, or permanently terminate any account that violates these terms, community guidelines, or applicable law, at our sole discretion and without prior notice.

The Service is provided 'as is' and 'as available', without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

We collect the minimum information necessary for the Service to function. When you authenticate via Discord OAuth2, we receive and store your Discord user ID, username, avatar URL, and display name.

We do not sell, rent, trade, or share your personal data with third parties for advertising, marketing, or any commercial purpose unrelated to the Service.

We use only strictly functional cookies (JWT session tokens and theme preferences). We do not use tracking cookies, analytics pixels, fingerprinting, or any third-party tracking technologies.

All payment processing is handled exclusively by Stripe, Inc. We never receive, store, transmit, or have access to your credit card numbers, CVV codes, or banking credentials. Stripe's privacy policy governs payment data.

Server access logs (IP addresses, request timestamps) are retained for a maximum of 30 days for security and abuse prevention purposes, after which they are automatically purged.

You may request a complete export of your personal data or the permanent deletion of your account and all associated data at any time by contacting us via Discord. Deletion requests are processed within 30 days.

In the event of a data breach affecting your personal information, we will notify affected users within 72 hours of discovery via Discord and/or email if available, in compliance with applicable regulations.

All payments are processed securely through Stripe, Inc., a PCI DSS Level 1 certified payment processor. Kaomochi never directly handles, stores, or transmits credit card information.

Premium purchases and support donations are one-time, non-recurring payments that grant permanent ('lifetime') access to premium features. There are no subscriptions, auto-renewals, or hidden fees.

Refunds may be requested within 14 calendar days of purchase by contacting us via Discord. Refunds are processed at our sole discretion. After 14 days, all sales are considered final.

All prices are displayed in United States Dollars (USD). Your financial institution may apply currency conversion fees, international transaction surcharges, or other charges beyond our control.

Kaomochi reserves the right to modify pricing at any time. Price changes will not affect existing purchases. We are not responsible for charges imposed by your payment provider or financial institution.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Kaomochi and its creators, contributors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill.

Our total aggregate liability for any claim arising out of or relating to these terms or the Service shall not exceed the total amount paid by you to Kaomochi in the twelve (12) months preceding the claim.

We do not guarantee uninterrupted, error-free, or secure operation of the Service. We are not responsible for any damage resulting from service interruptions, data loss, security breaches caused by third parties, or events beyond our reasonable control (force majeure).

You acknowledge that the Service integrates with third-party services (Discord, Stripe) and that Kaomochi is not responsible for the availability, accuracy, policies, or practices of such third-party services.

The Kaomochi brand, name, logo, source code, visual design, user interface, and all original content created by the platform are the exclusive intellectual property of the platform creators, protected by applicable copyright and trademark laws.

User-uploaded kaomojis, symbols, and text art are generally considered to be in the public domain. However, users are solely responsible for ensuring they have the right to upload any content and must respect original creators' attribution.

If you believe that content on Kaomochi infringes your copyright, you may submit a DMCA takedown notice via our Discord server. The notice must include: identification of the copyrighted work, location of the infringing material, your contact information, and a statement of good faith.

Counter-notices may be filed if you believe your content was removed in error. Repeated copyright infringement will result in permanent account termination in accordance with our repeat infringer policy.

We reserve the right to suspend or permanently terminate any account at our sole discretion, with or without notice, for any reason, including but not limited to violation of these terms, community guidelines, or applicable law.

Upon account termination, your right to access and use the Service ceases immediately. We may, at our discretion, retain or delete any content you have uploaded. Premium features purchased are non-transferable and non-refundable upon termination for cause.

You may delete your own account at any time. Account deletion is permanent and cannot be undone. All personal data associated with your account will be purged within 30 days of deletion.

Banned users are prohibited from creating new accounts. Circumventing a ban (through alternate accounts or other means) constitutes a further violation of these terms.

You shall not use automated scripts, bots, crawlers, or scrapers to access, extract, or interact with the Service without explicit written permission. Rate-limited API access is enforced and monitored.

Any attempt to probe, scan, or test the vulnerability of the Service, or to breach any security or authentication measures, is strictly prohibited and may result in legal action.

You shall not impersonate any person or entity, falsely claim affiliation with any person or entity, or misrepresent your identity in any way while using the Service.

Content that is illegal, defamatory, obscene, harassing, threatening, hateful, discriminatory, or that promotes violence is strictly prohibited and will be removed without notice.

You shall not use the Service to distribute malware, phishing links, spam, or any content intended to deceive, defraud, or harm other users or third parties.

If you are located in the European Economic Area (EEA), United Kingdom, or any jurisdiction with data protection laws, you have the right to: access your personal data, rectify inaccurate data, request erasure ('right to be forgotten'), restrict processing, data portability, and object to processing. To exercise these rights, contact us via Discord.

Data is processed on the legal basis of contractual necessity (providing the Service) and legitimate interest (security, abuse prevention). Consent is obtained separately for optional features. Data may be transferred to and processed in servers located outside the EEA, with appropriate safeguards in place.

These terms shall be governed by and construed in accordance with the laws of the European Union and the applicable laws of Spain, without regard to conflict of law principles.

Any dispute arising from or relating to these terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, either party may pursue resolution through the competent courts.

If any provision of these terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect (severability). The failure to enforce any right or provision shall not constitute a waiver of such right or provision.
